TERMS AND CONDITIONS

Official Language Clause:
The official language of these Terms and Conditions is Italian. This English version is provided for convenience only. In the event of any conflict or discrepancy, the Italian version shall prevail.

Governing Law and Jurisdiction:
These Terms and Conditions are governed by Italian law. The exclusive jurisdiction for any dispute is the Court of Lecce (LE), Italy.

1. Definitions

“Guest”: Any individual who books a property through the platform.
“Nord Sud Casa Vacanza” / “Company” / “We” / “Us”: The owner and manager of the platform, responsible for the managed properties.
“Host/Advertiser”: Third-party owners who list their properties on the platform.
“Managed Property”: Properties entirely managed by Nord Sud Casa Vacanza, including booking, check-in/out, cleaning, and guest services.
“Marketplace Property”: Properties listed by Host/Advertisers; bookings may involve commissions or membership fees.

2. Platform Use

By using our platform, you agree to:

Provide accurate and truthful information.
Respect the rights of owners, Host/Advertisers, and other users.
Comply with all applicable laws, including local tourism regulations.
Accept these Terms and Conditions.

3. Account Registration and User Obligations

Users must provide complete and accurate personal information.
Users are responsible for maintaining the confidentiality of login credentials.
Users may not impersonate others or create multiple accounts for fraudulent purposes.

4. SECTION A – Bookings Managed by Nord Sud Casa Vacanza

4.1 Booking Process

Guests may book Managed Properties directly through the platform.
Confirmation occurs upon receipt of full payment or deposit (based on the selected policy).

4.2 Payments, Fees and Tourist Tax

Payments are processed through secure payment gateways.
The booking price includes the property rental fees; the tourist tax (tassa di soggiorno), if applicable, is either included or charged separately, as specified in the booking summary.
Guests pay a deposit which may be 30%, a percentage fixed by the host, or a fixed security deposit, selected by the host in their Dashboard under Profile → Payment Method → Payment at booking stage.
The remaining balance, if applicable, is paid at check-in or according to agreements made with the host.

4.3 Check-in / Check-out & House Rules

Check-in/out times are specified for each property.
Guests must follow the specific property rules, including but not limited to occupancy limits, noise restrictions, and proper use of facilities.

4.4 Cancellation & Refunds

Policies for Managed Properties follow the property’s specific cancellation policies: Super Flexible, Flexible, Moderate, Strict, Non-Refundable.
Guests must communicate cancellation in writing via email or platform form.
Refunds or penalties are applied based on the policy selected by the host or the platform.
Non-Refundable policies only apply for full payment bookings.

4.5 Liability

The Company is liable for services managed directly, including accommodation, cleaning, and guest support.
Guests are responsible for damages caused to the property during their stay.

5. SECTION B – Bookings Managed by Third-Party Host/Advertisers

5.1 Host Responsibilities

Host/Advertisers provide accurate property information.
Host/Advertisers manage check-in, check-out, and any offered services or facilities.
Host/Advertisers are responsible for collecting any applicable tourist taxes.

5.2 Guest Responsibilities

Guests must adhere to property rules set by the Host/Advertiser.
Guests must communicate directly with the Host/Advertiser for any booking issues, unless reported to the platform.

5.3 Platform Liability

The platform acts as a marketplace for Host/Advertisers.
Nord Sud Casa Vacanza <strong>is not responsible</strong> for disputes, damages, or non-compliance arising from Marketplace Properties, except as required by law.
The platform may facilitate disputes but is not liable for third-party decisions or actions.
In case of cancellation by the host, the guest is entitled to an alternative property of equal or superior value (if managed by Nord Sud Casa Vacanza) or a full refund.

6. Content, Intellectual Property & Reviews

All content on the platform, including texts, images, videos, logos, and listings, is protected by copyright.
Users may not copy, distribute, or use content without prior authorization.
Reviews must be authentic and based on actual stays; fraudulent or defamatory reviews are prohibited.

7. Prohibited Conduct

Guests and Host/Advertisers may not:

Engage in fraudulent or illegal activities.
Use the platform to harass, threaten, or discriminate against others.
Manipulate bookings or listings to gain an unfair advantage.

8. Privacy & Data Protection

Personal data is collected and processed in accordance with our Privacy Policy (EU/GDPR).
Users must consent to data processing to complete registration or booking.
Data is securely collected and stored, used only for booking management, legal compliance, and customer support.

9. Cancellations, No-Shows & Overbooking

Managed Properties follow the platform’s standard policies (Super Flexible, Flexible, Moderate, Strict, Non-Refundable).
Marketplace Properties follow the policies set by the Host/Advertiser.
Nord Sud Casa Vacanza may facilitate refunds or alternative accommodations, but is not liable for third-party actions.
Guests must communicate cancellations in writing via email or platform form.

10. Liability & Disclaimers

Nord Sud Casa Vacanza is not liable for indirect, accidental, incidental, or consequential damages.
Liability for Managed Properties is limited to the services directly provided by the Company.
Liability for Marketplace Properties rests solely with the Host/Advertiser.
Nord Sud Casa Vacanza is not liable for:
- Events of force majeure (natural disasters, fires, theft, war, service interruptions).
- Discrepancies between the listing content and the property’s actual conditions.
- No-shows or overbooking outside Nord Sud Casa Vacanza’s control.
Guests are responsible for damages caused to the property during their stay.

11. Updates to Terms & Conditions

We may update these Terms & Conditions from time to time.
Users will be notified of substantial changes; continued use of the platform constitutes acceptance.

12. Governing Law & Jurisdiction

Governing Law: Italian Law.
Exclusive Jurisdiction: Court of Lecce (LE), Italy.
